Welcome to The Men Spirit. These Terms of Service ("Terms") govern your use of our website, participation in our face-to-face and online gatherings, and engagement in our one-on-one mentoring and therapy services.

By accessing our website or participating in any of our services, you agree to be bound by these Terms. Please read them carefully.

The Men Spirit is operated by Konstantinos (Kosta) Michalopoulos, operating as a Sole Trader. The Men Spirit is registered with the International Institute for Complementary Therapists (IICT) and operates in accordance with Australian laws and IICT standards of professional conduct.

1. Nature of Services and Medical Disclaimer

The Men Spirit is not a clinical mental health service, a crisis service, or a substitute for professional medical or psychiatric treatment.

We provide peer support, men's circles, mentoring, and holistic therapy services (including Root Cause Therapy™). While our founder is a Registered Nurse and our work is trauma-informed and evidence-informed, our gatherings and mentoring sessions are designed to support emotional wellbeing and personal growth, not to diagnose, treat, or cure mental illness.

It is your responsibility to seek appropriate medical or psychological advice for any health-related concerns. If you are experiencing a mental health crisis or are at risk of harm to yourself or others, you must immediately contact emergency services (000) or a crisis support service such as Lifeline (13 11 14) or Suicide Call Back Service (1300 659 467).

2. Eligibility

At this stage, participation in our face-to-face gatherings, online circles, and one-on-one mentoring is strictly limited to individuals aged 18 years and over.

We are committed to providing a safe environment. We reserve the right to refuse service or ask a participant to leave a gathering if we determine, at our sole discretion, that the service is not suitable for their current needs, or if their behaviour compromises the safety or wellbeing of themselves, the facilitators, or other participants.

3. Client and Participant Responsibilities

By participating in any of our services, you agree to:

•Provide Accurate Information: You are responsible for disclosing any relevant medical conditions, mental health concerns, or presenting issues that could affect your participation.

•Self-Responsibility: You acknowledge that you are responsible for your own emotional and physical wellbeing during and after our sessions or gatherings.

•Respect the Space: You agree to abide by our Group Agreements (for gatherings) and treat all facilitators and participants with respect.

•Maintain Confidentiality: You agree not to disclose the identities or personal stories of other participants shared during gatherings.

4. Bookings, Payments, and Cancellations

Payments

Payments for services, workshops, or mentoring sessions are processed securely via Stripe or direct bank transfer. Full payment is generally required prior to the commencement of the service unless otherwise agreed.

Cancellation Policy (Mentoring and Therapy)

We require a minimum of 24 hours' notice for the cancellation or rescheduling of one-on-one sessions. Sessions cancelled with less than 24 hours' notice will be forfeited, and no refund will be provided. Emergencies will be considered on a case-by-case basis.

Cancellation Policy (Gatherings and Workshops)

For paid gatherings, workshops, or group programs, refunds will only be provided if cancellation is made at least 48 hours prior to the event, unless otherwise stated in the specific event details.

Consumer Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If there is a major failure with our service, you are entitled to a cancellation and a refund. However, we do not offer refunds simply because you changed your mind after a service has been delivered.

5. Privacy and Confidentiality

Your privacy is paramount. We handle all personal and sensitive health information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

Limits of Confidentiality: All information shared with The Men Spirit remains confidential unless:

1.You provide explicit consent for disclosure;

2.We form a reasonable belief that disclosure is necessary to prevent a serious and imminent threat to your life, health, or safety, or that of another person;

3.We are required to report a reasonable belief of child abuse or neglect under mandatory reporting laws; or

4.We are required to disclose information by law (e.g., a subpoena).

6. Online Sessions and Recording

Therapy and mentoring sessions conducted online are facilitated through secure platforms (such as Carepatron or Zoom). While every effort is made to maintain a secure environment, you acknowledge the inherent risks of internet communications and agree to ensure you are in a private, secure location during your session.

No Recording: Participants are strictly prohibited from recording (audio or video) any face-to-face gathering, online circle, or one-on-one session. The Men Spirit will never record a session or gathering without obtaining the explicit prior verbal or written consent of all participants.

7. Intellectual Property

All content, materials, frameworks (including The Men Spirit Framework and Theory of Change), logos, and resources provided on this website or during our programs are the exclusive intellectual property of The Men Spirit.

You may not reproduce, distribute, modify, or commercialise any of our materials or frameworks without our express written permission. The materials provided during sessions or workshops are for your personal use only.

8. Limitation of Liability

To the maximum extent permitted by law, The Men Spirit, Kosta Michalopoulos, and our facilitators shall not be liable for any direct, indirect, incidental, or consequential damages, injuries, or losses arising out of or in connection with your participation in our services or use of our website.

By participating, you acknowledge that you accept full responsibility for the outcomes and risks involved, and you waive and release The Men Spirit from any liability relating to these services, provided they have been delivered with due care and skill.

All facilitators operating under The Men Spirit hold their own Professional Indemnity and Public Liability insurance. The Men Spirit holds comprehensive Professional Indemnity and Public & Products Liability insurance.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or your engagement with The Men Spirit shall be subject to the exclusive jurisdiction of the courts of Victoria.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting to this website, with the "Last Updated" date amended accordingly. Your continued use of our services following any changes constitutes your acceptance of the revised Terms.
